Non-Tip Activities Under New Tip Laws 

Under new rules created by the Federal Department of Labor, restaurants and hotels are required to pay wait staff higher hourly rates for tasks they perform that do not generate tips. This includes tasks like preparing food, cleaning, filling ketchup bottles, clearing tables when no customers are present, dining room prep work like setting tables, and many other tasks.  This means that wait staff CANNOT rely on tips from customers to supplement their pay for performing these tasks.

How can I start my claim?

If employers do not properly pay wages, employees can recover back wages for the last three years. Under the federal wage law, they are also entitled to double damages as a penalty. The Kennedy Law Firm has helped thousands of workers recover their back wages.
